Brand registration is the process of securing legal protection for the elements that identify your brand — your business name, logo, slogan, product names, and other marks that distinguish your goods or services from competitors. In the United States, brand registration is accomplished through federal trademark registration with the USPTO.
A federal brand registration gives you the exclusive right to use your brand identifiers nationwide, the legal presumption of ownership and validity, the right to display the ® symbol, access to federal court for enforcement, and the ability to block importation of infringing goods through U.S. Customs.
What Can Be Registered
You can register virtually any element that functions as a brand identifier, including business names and company names, logos and design marks, slogans and taglines, product names and line names, and distinctive packaging or trade dress. Most businesses benefit from registering at least their primary business name. Businesses with strong visual branding should also consider registering their logo. And businesses with memorable slogans should protect those as well.
