What Trademark Monitoring Actually Watches

Registration is not the end of the work. The USPTO does not notify you when someone applies to register a mark similar to yours — it examines that application against the register and, if it issues a refusal, that happens without your involvement. If the examining attorney does not catch the conflict, the mark publishes, and your thirty-day opposition window opens and closes whether or not you were watching.

A monitoring service watches new USPTO applications for marks confusingly similar to yours, flags them before publication closes, and gives you time to decide whether to oppose. Broader monitoring also covers state registers, domain registrations, marketplace listings, and social media handles.
